Khir Toyo faces assembly ban over Balkis case

SHAH ALAM, March 27 – Datuk Seri Dr Mohd Khir Toyo could be banned from the Selangor assembly while his wife faces possible police action for not attending the Balkis inquiry.

State speaker Teng Chang Khim said both are in contempt of the State Assembly when they failed to attend the Select Committee for Competence, Accountability and Transparency (Selcat) inquiry into Balkis, a charity set up by the former Barisan Nasional state government for their wives.

“It’s the Legislative Assembly which established Selcat and action can be taken against Dr Khir, who is a member of the Assembly, while his wife is liable for criminal action under Section 3 of the Contempt of the House Enactment 2008,” Teng said today.

He said Selcat has recommended that Dr Khir be sent to the Selangor Assembly’s. Privilege Committee while a police report will be lodged against his wife Datin Zahrah Kechik for failing to attend the inquiry.

Teng disclosed that any member of Selcat can refer the former Selangor Menteri Besar to the Privilege Committee while the Selcat secretary will lodge the police report against Zahrah.

“It will then be the responsibility of the police to conduct investigations and refer the report to the Attorney General (AG) Chambers to determine if she should be charged, in court.”

Teng said by convention, Dr Khir can be suspended, without pay from the Assembly.

On Monday, solicitors representing Dr Khir and Zahrah, sent letters informing the committee they would not be attending the public inquiry because Selcat did not have “certification” from the AG.

Teng said Dr Khir was ignorant of the state Constitution and Standing Orders which is the basis of the establishment of the Selcat.

“Selcat does not need certification because the State Assembly is a legislature and does not come under the supervision of the AG.”

Teng added no Barisan Nasional assemblyman, including Dr Khir had apposed the motion to establish Selcat when it was tabled in the state assembly last year.

“In fact, two Barisan Nasional members in Selcat had taken part in meetings and were in attendance on the first day of the public inquiry.”

In the inquiry today, Selangor Registrar of Society (ROS) deputy registrar Yunos Jamil admitted Balkis accounts were not audited by authorised auditors, when he supported an application to dissolve the charity.

Upon checking the accounts of the charity,which was submitted with the application to dissolve the Balkis, Yunos told the Selcat the accounts, were not signed by any auditor.

However in his earlier testimony, Yunos had said audited accounts were necessary before any society could be dissolved and he was satisfied that Balkis had fulfilled all requirements.

Yunos was at a loss to explained the discrepancy, which he described as an oversight, and argued that nothing could be done because the decision to dissolve Balkis was made by a minister, in Putrajaya.

But Teng pointed out that it was an offence for any one to submit fraudulent reports to the ROS under the Societies Act.

However, Yunos maintained his department was powerless to act.

Yunos also testified that Balkis had almost RM10 million in cash when it was dissolved but did not have a list of its other assets.

He is due to return before the Selcat on Monday.

SHAH ALAM: State subsidiaries said they felt "obliged" to pay expenses incurred by the Wives of Selangor Elected Representatives' Welfare Association (Balkis) to organise functions and admitted that Balkis was "special" compared with other non-governmental organisations.

The Select Committee on Competence, Accountability and Transparency (Selcat) was told at its first-ever hearing at the Dewan Annex here, yesterday, that many of the sponsorships were requested verbally by former Balkis chairman Datin Seri Zaharah Kechik.

The representatives of all three state subsidiaries who testified -- Selangor Agriculture Development Corporation (PKPS) deputy general manager Mohamad Nordin Darhan, former Selangor State Development Corporation (PKNS) chairman Datuk Harun Salim and Kumpulan Darul Ehsan Berhad (KDEB) president Datuk Abdul Karim Munisar -- said they paid the bills forwarded to them by Balkis.

"It looks like it was not a matter of sponsorship but the state subsidiaries becoming 'tukang bayar' (paymaster) for Balkis," said Selcat chairman Teng Chang Khim at the hearing.

KDEB forked out almost RM700,000 to sponsor Balkis functions from 2002 to 2005.
This included RM17,000 for flight tickets for seven to Guangzhou where the Balkis entourage headed by Zaharah spent RM206,574.89, also paid by KDEB, to buy souvenirs such as multi-coloured flowers and 2,700 pieces of caps at RM8 each.

Karim said it was "very difficult" to reject sponsorship applications from Balkis as it was very influential and KDEB belonged to the state government, where Zaharah's husband, Datuk Seri Dr Mohd Khir Toyo was the menteri besar at the time.

PKNS and its subsidiaries spent about RM1 million until 2007 to sponsor Balkis events, a third of it on dinners alone. The corporation also sold two pieces of land below market price to Balkis.

Harun said PKNS never rejected any application from Balkis, which Teng described as "amazing".

PKPS in 2006 paid about RM46,000 in tent rental and hampers for Balkis' functions, 46 per cent of its yearly budget for sponsorship.

Also called to testify yesterday was State Secretary Datuk Ramli Mahmud.

Zaharah and Dr Khir who were scheduled to give their statements today may only be called tomorrow.

However, it is not known if they will attend as Dr Khir has labelled the Selcat hearing as not valid.

Teng said the validity should not be questioned as Barisan Nasional was represented by two assemblymen and both actively participated in the hearing yesterday.

SHAH ALAM (March 23, 2009) : Kumpulan Darul Ehsan Bhd (KDEB) paid for the flight tickets of seven members of the now defunct Selangor assemblymen and MPs wives charity organisation (Balkis) for a “souvenier shopping” trip to Guangzhou, China on May 2007.

The cost of flight tickets for one business class and six economy class seats was RM17,438, KDEB head Datuk Abdul Karim Munisar told the Select Committee on Competance, Accountability and Transparency (Selcat) of the Selangor State Assembly on the first day of its probe into contributions disbursed to Balkis.

Abdul Karim said the company paid more than RM206,000 for the souvenirs from China which included a few hundred stalks of artificial flowers in various colours and 2,700 hats – 900 in red, yellow and purple colours respectively.

This was despite the fact that the invoice indicates that the supplier has a local branch based in Kuala Lumpur. The entire cost was absorbed by KDEB which is a state investment arm under its Corporate Social Responsibility (CSR) programme.

Abdul Karim added that KDEB had spent a total RM65,300 to buy Songket material to be given as gifts to the Sultan, Datin Seri Rosmah Mansor, Tun Dr Mahathir Mohamed and Tun Dr Siti Hasmah Mohd Ali at a function hosted by Balkis in February 2006 and about RM25,000 for souvenir chocolates.

The company also paid RM100,000 for dinner organised by Balkis at the Sunway Lagoon Resort and Spa Hotel on July 24, 2007. This was a week before the association co-hosted three dinners costing RM450,000.

The first two dinners on Aug 2 and 3 were held at the same venue and the third on Aug 4 was held at the Sunway Lagoon Theme Park hotel. The cost was borne by the state government with the approval of the financial officer and endorsement of the executive council (exco).

Grilled by the Selcat which is chaired by Selangor state assembly speaker Teng Chang Khim on Monday over these payments KDEB made under its CSR programme president Karim Munisar said: “We do not question the relevance of this as it was determined by the previous state government, and there are no criteria or guidelines. Now KDEB is under a new government and if they change the policy and stipulate guidelines pertaining CSR programmes, then we will adhere to it.”

Karim was one of the four witnesses who testified before the seven member Selcat panel made up of five Pakatan Rakyat assemblymen and two Barisan Nasional representatives.

The other Selcat members are Bkit Antarabangsa state assemblyman Azmin Ali, Taman Medan assemblyman Haniza Talha, Ulu Kelang assemblyman Shaari Sungib, Bukit Gasing assemblyman Edward Lee, Dusun Tua assemblyman Ismail Sani (BN), and Permatang assemblyman Sulaiman Abdul Razak (BN).

He said if the president approves the appeal for funding from organisations like Balkis then the board would have to endorse it.

Asked what would happen if he had not approved it, Karim replied: “Susah lah! (that’s hard)”.

Several state company representatives and their subsidiaries also admitted that they were obliged to pay for the cost incurred by Balkis saying it was a practice which they did not question.
The heads and former managers of the companies said that although they agreed to pay for expenditures, the approvals were based on estimates.

The final cost would be paid to suppliers based on based on bills that Balkis forwarded to the companies.

Earlier during the morning session, state secretary Datuk Ramli Mahmud said the CSR guidelines for state companies are determined by the companies themselves and that there was no fixed guideline.

“It is for the CEOs to decide on based on their budget allocations,” he said.

Ramli also denied that where the state was concerned there was no special treatment for Balkis as the organisation had to write in to ask for financial assistance if they wanted it.

He said the RM450,000 contribution for Balkis dinner at the Sunway Lagoon Resort and Spa Hotel and the Sunway Lagoon Theme Park Hotel were a one-off contribution to the organisation and the state took into account the fact that the organisation was run by the wives of state representatives.

We received the endorsement of the state executive council (exco) and the financial officer to host the three events which wives of elected representatives from all 13 states in the country attended , with Balkis as the co-host, he added.

Meanwhile former Perbadanan Kemajuan Negeri Selangor (PKNS) general manager Datuk Harun Salim agreed with the committee when asked if PKNS was a “tukang bayar” (pay master) for Balkis as the association would forward its bills to the company to be paid.

He said the organisation would usually forward requests to the company to sponsor some of its programmes and admitted that the company usually felt obliged to support Balkis.

Harun however denied that he was concerned about repercussions if he did not endorse the sponsorships because he said his performance and the profits of the company were good.

Therefore this was not a reason he took into account when approving the soponsorships.

PKNS and its subsidiaries had also contributed large sums to Balkis including RM300,000 for the three dinners held on Aug 2,3 and 4.

Pebadanan Kemajuan Pertanian Selangor (PKPS) Mohd Nordin Darhan who also testified before Selcat said the company had on Jan 2006 contributed RM46,000 for the officiating of Balkis complex in Section 7, Shah Alam including the cost of 150 fruit hampers for guests.

Balkis received huge cash payments from Selangor government

SHAH ALAM, March 24 — Paid trips to Cambodia and Indonesia, cash payments, a mass wedding for converts, and expensive gifts for VIPs, all in the name of Corporate Social Responsibility (CSR), dominated day two of a public inquiry into the Wives of Selangor Elected Representatives Charity Organisation (Balkis).

Today, it was the turn of Permodalan Negri Selangor Berhad (PNSB) chief executive officer Datin Khairiyah Abu Hassan to be “grilled” by the Selangor Select Committee for Competency, Accountability and Transparency (Selcat), over funds which was provided to Balkis since 2002.

Khairiyah, who was accompanied by four aides, disclosed that it was a common practice for the state subsidiary to adhere to all “request” for funds from Balkis, which amounted to between almost RM500,000 to RM1.6 million, annually.

Khairiyah told the committee headed by Selangor speaker Teng Chang Khim that as a state subsidiary it adopted a “compromising attitude” as they wanted to support the state in all projects which improved the

image of the administration.

Khairiyah, who was deputy CEO in 2002, disclosed that it was “usual practice” for Balkis officials to make verbal requests for project funds, and it was not unusual for the payments to be made in cash.

During the inquiry she said the “instructions” were sometimes made over the phone but she later retracted and used the term ‘request’ instead which prompted Teng to remind her that she was testifying under oath.

She admitted she had a close relationship with former Balkis president Datin Zahrah Kechik, who is the wife of former Mentri Besar Datuk Seri Khir Toyo,and added there was no committee to scrutinise the

“request” for funds or how the money was used.

Khairiyah said all requests were approved by the PNSB board collectively.

In 2002, PNSB funded a journey of repentance and self-realisation (Keinsafan) for Balkis members. A total of RM82,000 was paid and the money was used to food, accommodation and humanitarian projects as well as an allowance of RM3,000 for a reporter.

Khairiyah said RM38,000 was dispensed in cash and PNSB did not receive a receipt for the money.

In the same year, Balkis also received RM250,000 of which RM100,000 was in cash, to run a motivational camp for SPM students.

Khairiyah said she is not sure what the cash was used for and did not know who ran the course or why the money needed to be paid in cash.

In 2003, PNSB allocated RM1.65 million to Balkis of which RM148,280 was used to fund a mass wedding of 51 couples who were new converts at Dewan Belia and Sukan in Shah Alam.

Almost RM90,000 was spent on food for the estimated 1,500 guests at the wedding and Khairiah admitted there was no proper documentation on how the rest of the money was spent.

“It is negligence and carelessness on our part,” she admitted.

Khairiyah was at a loss to explained why huge amounts of cash was being dispensed to Balkis over the year and who received the money.

In 2004, PNSB paid RM3,600 for a “Summermen” suit for its then chairman Dr Mohd Khir Toyo as a souvenir for attending a Chinese New Year function, contrary to General Orders that gifts should not cost more than RM1,000 .

In the same year PNSB paid RM16,000 for Balkis members to go on a trip to Bukit Tinggi, Indonesia.

Meanwhile in 2006, PNSB paid RM50,000, in cash, for the opening of Complex Wawasan Balkis in Shah Alam, RM13,000 for food and a singer for a Buka Puasa dinner and RM25,000 for several tables at a

Balkis charity dinner.

In 2007, PNSB paid RM338,547.97 for the Balkis annual sports event of which RM33,000 was used to buy uniforms for participants.

Teng remarked that PNSB had functioned like a cashier to Balkis and added the Select Committee was concerned with the lack of corporate governance by the state subsidiary.

The inquiry continues tomorrow.

(雪 蘭莪‧沙亞南)雪州議會能力、公信力及透明度特別遴選委員會(SELCAT)今日(週二,3月24日)進行第二天的聽證會,雪州國阵州議員夫人俱樂部 (BALKIS)的幕後最大“金主”,雪州投資機構(PNSB)坦承,從2002年至2007年間,他們提供此俱樂部的贊助費,高達519萬令吉。

換言之,此機構每年平均提供86萬獻金給BALKIS,除了讓她們辦國內的慈善活動外,也固定使用當中的10至25萬,作為此俱樂部的行政開銷。
原本安排在週二供證的PNSB首席執行員拿汀凱莉雅,週二才正式登場。她說,她在1991年時加入PNSB做策劃組官員,2002年升任副首席執行員,一直到2007年則是成為PNSB的首要人物。

她供證時披露,從2002年開始,PNSB每年固定撥款100萬令吉給此俱樂部提出申請,只要他們提出的申請在撥款預算中,都會被批准,印象中沒有拒絕過任何一筆對方所提出的申請。
她指出,PNSB之所以把偌大的撥款發給此俱樂部,是基於幾個原因,即PNSB是雪州政府子公司,公司主席是雪州大臣,BALKIS主席是雪州大臣的妻子,這層層關係連接起來,PNSB必須為BALKIS提供贊助。

她解釋,PNSB在雪州政府的協助下成長,回饋社會是州政府及公司的宗旨,當BALKIS與州政府合作進行各項慈善及社會援助活動時,為了提高州政府的聲譽及形象,PNSB都會義不容辭地以金錢資助。

不過,像週一(3月23日)4名證人的供詞一樣,凱莉雅承認,只要是BALKIS提出的撥款申請,他們一般都不會去檢查他們需要獻金的目的,或者辦活動的內容。
特委會成員之一的國際山莊州議員阿茲敏阿里提出疑問,就算此俱樂部的活動只惠及部份特定人士,廣大民眾並沒有受惠,PNSB仍然通過對方所提出的撥款申請?凱莉雅點頭說:“是”。

從2002年起“特別優待”
阿茲敏阿里在聽證會上提到,BALKIS從2002年開始獲得“特別優待”,似乎和拿督斯里基爾上任為雪州大臣有很大的關係,進而要求她說明她與基爾夫人的交如何。
她先是回答“挺密切”(quite close),也解釋說她們的交情不錯,主要是她們常在一起辦活動,PNSB前首席執行員還特別交代她要跟進BALKIS的所有活動。

不過,當特委會主席鄧章欽要求她針對與前大臣夫人的關係,從3個說明中,即“非常密切”、“挺密切”及“密切”,選出一個貼切的形容詞時,她先是猶豫了一下,再輕聲說到“密切”(rapat),比之前的“挺密切”降了一級。

為了確保聽證會公平及公正,5名主持聽證會的SELCAT成員以連珠炮的方式追問凱莉雅有關獻金一事,有些提問更是一針見血,讓她無法即時回答,只能尷尬地保持緘默、點頭默認或含糊回應。

(雪 蘭莪‧沙亞南)由能力、公信力及透明化特別遴選委員會(SELCAT)主持的聽證會,今日(週一,3月23日)在雪州議會附屬大廈舉行。數個雪州政府子公 司代表週一在供證時,聲稱在2007年時提供75萬令吉的獻金,給雪州國州議員夫人俱樂部(BALKIS)舉辦全國國州議員夫人晚宴。

他們承認,他們是在半自願半強迫(oblige)的況下,撥款給此俱樂部,沒有拒絕的能力,更沒人敢推辭,同時也承認他們是“付錢匠”(tukang bayar),只要帳單一來就得付錢。
首次召開的聽證會,由能力、公信力及透明化特別遴選委員會(SELCAT)主席鄧章欽主持,出席聽證會的委員會成員包括國際山莊州議員阿茲敏阿里、丹花園州議員哈尼查、淡江州議員沙阿里、武吉加星州議員李寶霖、柏馬登州議員蘇萊曼及杜順大州議員依斯邁沙尼。

2007年付75萬獻金
截至中午1點半為止,已有4名證人輪流供證,他們是雪州政府秘書拿督南利、雪州農業發展局副總經理莫哈末諾汀、Darul Ehsan公司主席拿督阿都卡林、以及雪州經濟發展機構前總經理拿督哈侖沙林。
南利是第一個被傳召供證的人士。他指出,雪州政府在2007年撥出45萬令吉,給此俱樂部在雙威酒店,舉辦一連3天的全國國州議員夫人晚宴。

這項晚宴在2007年8月2日至4日之間舉行,分為開幕、與雪州蘇丹聚餐及閉幕等三項晚宴。
不過,參與人數、吃甚麼、連續3天的晚宴中做了甚麼,沒有一名證人可提供相關資訊。
根據受傳召人士所給的口供,晚宴主要“贊助商”除了雪州政府,還有雪州經濟發展機構。此機構母體“貢獻”逾16萬令吉,其子公司World Wide再注入逾14萬令吉,總得來說,已曝光的晚宴“捐獻”,衝破75萬令吉大關。

先辦晚宴再要求獻金
已退休的雪州經濟發展機構前總經理哈侖沙林表示,此俱樂部在舉辦晚宴後,才把要求獻金撥款的信發給他們,再由他們的政部門,把這筆款項撥出去。
他含糊的說,雪州國州議員夫人俱樂部的獻金申請一般都會在沒有異議的情況下被通過,而且很多時候他們拿到的是單據,只要憑單付費即可,不必去過問這筆鉅額款項用在哪裡,或者做了些甚麼。

委員會提出疑問,質疑雪州經濟發展機構何以在沒有監督獻金用途的情況下就通過這筆撥款,他解釋,他們是按章行事,“上頭”要他們做甚麼就做甚麼,不會去過問金錢的流向。
詢及此俱樂部是否曾在得捐款後,向提供撥款的雪州政府子公司表達感謝時,哈侖沙林搖頭否認,還爆料說,他們還得額外繳付1萬令吉作為認購該晚宴的一座餐券。

特殊待遇禁過問
4名證人在供證時不約而同地表示,雪州國州議員夫人俱樂部基於其主席是前雪州大臣夫人的關係,她們確實獲得政府各子公司的特殊對待(layanan istimewa),而這種對待方式是不允許被過問的。
首名證人南利指出,此俱樂部所要求的撥款,在前雪州大臣或行政議會通過後,由雪州政府財政部門核准,而他的職責是把撥款分發出去,不准過問。

第二名證人莫哈末諾汀,雪州農業發展局前後提供此俱樂部3次的捐款,總額逾4萬6000令吉,作為租用帳篷、活動場所及水果籃等用途。
“她們提出申請時並沒有說明要多少的捐款,不過我們在她們辦完活動後,就會收到各種開銷單據,之後再依照單據上的數目付錢給此俱樂部或供應商。”

第3名證人阿都卡林被詢及此俱樂部的撥款申請是通過書面或口諭而已時說,有時候是大臣自己提出的要求。他也提到,大臣的要求一般難以推搪,他們必須照著做。
他所代表的Darul Ehsan公司,在2002年至2007年間,提供12筆捐款共67萬3000令吉給此俱樂部,其中兩筆直接交給活動供應商。
上午時段最後一名證人哈侖沙林,是所有證人中較為坦率的一個。他對雪州國州議員夫人俱樂部擁有特別待遇一事直認不諱(honestly, yes!),還說他們不曾拒絕任何一筆此俱樂部的捐款要求。
他說,雪州經濟發展機構每一年都準備100萬令吉的撥款,作為慈善及非組政府組織的經費用途。

“過去兩年,包括我們的子公司在內,我們捐給此俱樂部的錢多達95萬8000令吉”,此話一出時,即引起委員會成員及旁聽者嘩然。

鄧章欽揶揄要錢真容易
按照初部計算,雪州經濟發展機構兩年內高達200萬令吉的慈善撥款,其中一半已被俱樂部夫人“瓜分”,鄧章欽忍不住打岔說“我們都加入俱樂部”好了。
他揶揄該“伸手將軍”(指此俱樂部)要錢要得真容易。

雪州國州議員夫人俱樂部(Balkis)引起的爭議,是在去年雪州政權易手後爆發,至今將近一年。
據報導,此俱樂部在民聯執政雪州後不久,便宣佈解散,並移走990萬令吉的款項和房產。

雪州政府針對此案召開聽證會,傳召包括前雪州大臣拿督斯里莫哈末基爾夫婦在內的11人出席供證。
拒絕供證的被傳召者可受到對付。倘若違抗者是州議員,該 委員會可將他們交由州議會特權委員會對 付,所面對的懲罰可能是禁足州議會或取消州議員津貼;若非州議員,則可在2008年藐視議會法令第3條規下,交由警方採取行動,罪成者可被監禁不超過12 個月或罰款不超過3000令吉,或兩者兼施。
聽證會將在3月23至31日上午10點至下午5點,在州議會附屬大廈的議會聽舉行。除了媒體和非政府組織受邀出席,公眾也可旁聽,現場約可容納200人。

被视为开明派马来人代表的首相署部长再益依布拉欣,今午推介首本马来文著作自传--《我也是马来人》(Saya Pun Melayu),透过本身的参政经验来探讨马来社群所面对的政治社会问题。

这名遭巫统开除的前部长,邀请民联两大巨头—人民公正党实权领袖安华与回教党精神领袖聂阿兹,为其新书主持推介礼。

推 介礼在八打灵再也一家高尔夫球俱乐部举行,出席的约300名受邀嘉宾包括前最高法院院长沙烈阿巴斯、前高庭法官赛阿末依迪(Syed Ahmad Idid)、行动党升旗山国会议员刘镇东 ,以及前吉兰丹州克拉纳斯(Kok Lanas)国会议员阿都拉阿末(Abdullah Ahmad)。

zaid ibrahim book launching 230309 anwar安华(左图)为新书进行点评时指出,虽然再益口操一口流利英语,加上其行事作风,往往被视为自由派马来人(Melayu Liberal),然而事实上再益却是出身吉兰丹甘榜的“纯正”马来人,就读的高等教育机构也是国立玛拉工艺大学。

他表示,新书继续深化针对马来人问题的探讨,“我相信是刻意选择在巫统全国大会的前一天推介,我希望巫统中央代表来得及读这本书”。

大力主张废除新经济政策的安华指出,再益也在新书内讨论新经济政策,然而不幸的是,所有质疑新经济政策的马来人都被巫统一味标签为“叛徒”,但是巫统却从来不准备进行辩论。

他说,新书不乏对政治领袖的评价,其中对前首相马哈迪的抨击从头至尾不曾间断;针对回教党,再益虽然不曾加入该党,却认同该党领袖的能力;再益也承认槟州首席部长林冠英执政槟州后,实行更公平对待各族的政策。

再益在致欢迎词时指出,他于90年代加入巫统后,所活跃的政治地区恰好就是回教党的堡垒吉兰丹,但是聂阿兹身为回教党最高领袖,却从来不曾以刻薄的言语来贬低他。

“我在巫统的前同僚却不同,我在成为党员、部长甚至离开后,依然成为他们不断攻击的目标。马哈迪就骂我是笨蛋、不理性,(巫统署理主席候选人)慕尤丁指我是‘叛徒’。”

“这让我萌生问号,从领袖的行为举止来看,哪个政党比较成熟崇高?”

劝马来人参与辩论保持清醒

他语重心长地表示,若马来人要解决本身问题,就必须保持清醒,千万不要混淆,而保持清醒的先决条件就是持续性的讨论与辩论。

“我希望这本小书能在这方面尽一些绵力。”

除了再益的自传《我也是马来人》,推介礼也推介另一本由阿都苏克尔(Abdul Shukur Haron)与阿努亚(Annual Bakri Haron)编辑的《聂阿兹的光芒》(Kemilau Peribadi Nik Aziz)。

安华不满媒体专挑民联问题

此外,受询及公正党委派政坛新人马尼古玛(S Manikumar)上阵武吉士南卯州议席补选,掀起党内不满浪潮一事,安华坚称当地选民还是满意马尼古玛。

他也埋怨主流媒体一面倒攻击民联,仿佛只有公正党的候选人面对问题,国阵候选人却获得各造的支持,但是事实上国大党内的失意分子将委派另一名候选人来挑战现有的国阵候选人卡尼申(S Ganesan)。

由于安华需要马上赶往武吉士南卯出席竞选活动,聂阿兹也急于离开,记者会在不到短短10分钟就结束。

(吉隆坡23日讯)时评人迦玛认为“若巫统和国阵要彻底改变金钱政治的问题,只有下台才能真正和贪污,舞弊切割关系。”若巫统一日还在位,它没办法自己深思自身的问题。

国阵成员党之间已经出现许多问题,其内部机制已经和国家经济挂钩,导致贪污,舞弊和滥权等现象出现。迦玛形容国阵的机制已经生绣,没办法让国阵有自我疗伤的机会,必须彻底放弃政权才能解决现有的问题。

政治权谋的博弈是短暂的,通常得以制敌于迅雷不及掩耳之速,却也可能引起政敌以及旁观利益相关者(这里指的是选民)更大的反弹和反扑。以快、很、准的茅招来算计政敌,固然可以让政党和政治人物取得立竿见影的挫敌之效,却也通常很快就落得“杆倒影不再”的窘境。

真正能够让政党以巨大优势长久凌驾对手的政治策略和手段,没有捷径,只有提出全新论述一途,以更具说服力、涵盖层面更广、道德制高点更优越的论述来化解对手的恶意攻诘于无形,甚至进一步收编对手的政治支持力量。

政治论述诉诸的对象是群众,抢夺的是足以促成长久结构性变局的政治板块;反之,政治权谋争夺的只是政治资源以及一时的政治气势,只能换取投机政客与利益集团短暂的支持,却无法开拓实质的政治后援势力。

用新论述吸纳大量中间选民


anwar ibrahim and pkr speech公 正党在去年308大选之前是所有马来西亚政党当中,最有论述架势的政党。当时安华提出了以《人民主权》(Ketuanan Rakyat)来替代巫统的马来主权(Ketuanan Melayu);以不分种族、宗教扶贫的《新经济议程》(New Economic Agenda)来取代巫统独惠国阵朋党的新经济政策(New Economic Policy)。

夹着非巫裔选民以及城镇地区中下层巫裔对巫统贪腐文化以及金钱政治的高度不满,公正党意外的以这两个初具轮廓、仍未见其实质全貌的政治论述吸纳了大量的中间选民游离票源,在308大选中大有斩获,一举从国会蚊子党一跃成为国会最大反对党。

专注夺权大计招致政治挫败


najib and perak hee jamaluddin osman nasaruddin然 而,在成功引领反对党联盟否决国阵三份之二的国会大多数议席优势,并夺下5个州属执政权后;公正党却逐渐荒废了在政治论述层面上的进一步耕耘,反而汲汲营 营于916夺权的大计,甚至为了获取马来皇室的支持而在公正党常年大会上提出恢复君主免控权的倡议(后来因为反弹,修正为“恢复统治者立法御准权”),以 致后来夺权不成,反而被纳吉“蚀把米”发动“苏丹政变”(潘永强语)强行拿下霹雳州执政权,并不断为反对党尤其是公正党以及回教党的霹雳州州务大臣尼查扣 上“叛君”(derhaka)的帽子,政治声势就此节节败退,甚至要守住阵脚,设下停损点也屡露拙相。

宣布反击国阵3R宣传攻势

无 论如何,在政治论述从缺、跳槽变天谣言满街飞大半年后,欣闻安华在日前于公正党全国国州领导层干部的讨论会议上又尝试重新提出新的论述,要求该党领袖引领 人民走出巫统向马来社群发动的3R宣传攻势,避免马来民族重新退回狭隘、落伍与封建的思维,让巫统分而治之的伎俩得逞。

用汉惹拔事迹撼动愚忠和盲从

安 华所指的巫统3R宣传策略是——Race(种族)、Religion(宗教)与Royalty(皇室)。而安华提出化解当前最棘手、来自巫统对该党的叛君 污蔑(属于巫统的Royalty策略范畴)的论述,主要是以形象中庸、英明、广为马来社会传颂的马六甲王朝宰相敦霹雳(Tun Perak)敢于违抗马六甲苏丹下令杀死汉都亚(Hang Tuah)旨意的典故为“抗君”的楷模,来反驳巫统的宣传攻势,而非以更具正义感、义气和血性,却也拥有更浓厚叛君色彩的汉惹拔(Hang Jebat)来唤醒大家避免落入愚忠和盲从的迷失。

在《汉都亚传奇》(Hikayat Hang Tuah)中,虽然汉惹拔和敦霹雳都同样同情汉都亚的遭遇而做出叛君的行为,可是,故事的结局却是敦霹雳与汉都亚最终站在同一阵线保卫马六甲苏丹,汉都亚更因为“成功歼灭”欲对马六甲苏丹不利的汉惹拔而获得苏丹的赦免和嘉奖。

因此在引用“抗君”楷模的选择上,安华选用敦霹雳是较符合“马来正史”的,换句话说,也更政治正确和更能让马来平民接受的。巫统的宣传机器不太可能敢于作出任何玷污顿霹雳在马来群众心目中地位的攻势。

正视民族、宗教和皇室的民主阻力

事 实上,安华在308大选前和大选后的一年内,为了维持和争取马来种族和宗教保守势力的支持,其提出的《人民主权》(Ketuanan Rakyat)以及《新经济议程》(New Economic Agenda),其实只是以更具包容性和更公正的国家资源分配方式来挑战巫统身为唯一合法马来族群权益捍卫者地位的政治论述,并未有触及敏感的民族、宗教 和当时仍未被视为民主进程阻力的皇室,这三大根植马来群众思维的政治范式转移。
而安华此次在公正党内部会议内首次大胆提出反对党必须以坚定但“更具公关手腕”的方式带领马来群众走出巫统点燃的“3R”迷失的发言,不失为公正党乃至整个民联弥补《人民主权》以及《新经济议程》无法实质引领马来保守群众改变种族和宗教部落思维的论述不足之处的契机。

诚 然,在国阵通过牢控警察部队、反贪污委员会,甚至是州议会秘书,对民联各地州政府进行全面的围剿,并通过主流媒体对民联扣上叛君和出卖民族权益的帽子,民 联尤其是公正党已经到了背水一战的悬崖,再也没什么好输和好顾忌的了!以其束手缚脚任凭国阵继续通过党国机器压挤生存空间,却由于害怕失去保守社群的支 持,而在政治发言的攻防上处处自我设限、步步退守,倒不如提起政治勇气开创一套全新的政治论述,以釜底抽薪之势对巫统操弄民粹的愚民手段展开全面的反击。

化 解纠缠马来西亚几十年的种族、宗教与封建政治的新论述之“前言”已经在公正党的内部会议上正式推介,安华以及其领导的公正党,必须以坚定的政治意志和过人 的魄力来发挥去年308大选前后的牵线人角色,通过后续更完整的政治论述,把回教党和行动党拉在一起,让三党为了更长远的利益抛弃歧见,共同在民间展开化 解巫统“3R”思想的解魅运动,让马来西亚人民摆脱巫统以种族、宗教和叛君议题来分化人民达到长久独裁统治的愚民宿命。

谁挡住了民主的阳光?

【乱石崩云/唐南发专栏】我不常读美国《世界日报》总编辑陈裕如的文章,也不清楚他对很多重大议题的立场。但他日前在《星洲广场》访谈中的一段谈话却是可圈可点的:

“民主和人权是需要争取的,是一个逐步发展的进程。当你看到有阴暗的地方,就要把窗户打开让阳光照进来,这就是媒体的责任。”
陈先生谈到媒体的责任是“让阳光照进来”,无疑有着对办报的崇高理念;但就在刊登这则专访的同一天,《星洲日报》的头版头条是什么呢?
内容当然了无新意,不过是准首相近乎样板式的谈话,例如“各种机会将公开给所有种族,政府的未来政策和方针,也将会更公平和合理”云云。
我的疑问是:这种陈腔滥调算是新闻吗?或者,它有新闻价值吗?
谁还在乎纳吉?
从 马哈迪在1990年代致力塑造所谓的“马来西亚民族”开始,巫统领袖时有类似的谈话,但都空雷不雨,统统沦为针对非马来人社会的文宣。尤有进者,巫统下线 甚至二、三线领袖为了党选或个人政治目的,不惜炒作种族议题,以耸动的言论掩饰本身的施政弱点,面对民间团体的炮轰却依然老神在在。
特 别是过去数年,非马来人民众屡次被巫统极端份子所激怒,而自称代表这些族群的政党,长年在国阵内部尸位素餐甚至逃离政治;巫统的贪婪腐败和首相阿都拉巴达 威的无能也让马来人叫苦连天。巫统口惠而实不至,纵使“宏愿”神话出台至今将近廿年,国家在政经文教各个领域已经倒退到民众必须背水一战的地步。
就是这种强烈的无力感和悲愤促使民众自我组织起来,趁着阿都拉时期,威权主义歇息的片刻试图抗争。经过了去年3月8日全国大选,民众清楚看到自己发挥的力量,也更珍惜结社和言论自由。在这个时候,谁还会有兴趣知道纳吉(右图)上台后将如何对待其他族群?
1981 年,马哈迪出任首相之时,华社私下追问:“他会如何对待华人?”的集体族群焦虑症候;到了2009年,民众却普遍担忧纳吉上台之后将“重点”打击言论和结 社自由,就连精英学者所不屑的市井小民和鳏寡孤独者都深恐马哈迪主义复辟,再也没有明日。我们用了一代人的时间教育自己:无论完人、善人甚或强人,都不能 保障民众的权益;一个完善而强大的监督机制,才能确保国家得以永续经营。
所以,我敢断言在纳吉即将走马上任“继承”其先父遗志的前夕,社会大众,特别是在被压制多年后初见民主曙光的华社,最在意的并非新首相会否善待华人,而是他有没有意愿彻底改革,整顿,甚至在必要时候把现有的体制扫进历史。
2008 年的政治海啸至今已然一年,但之后一系列的发展才是民主运动的起步。今天民众普遍不再期待明君,而是要求体制改革。故此,纳吉再做一千次、一万次的保障要 公平对待各民族是没有意义的。一来,民众已经不相信一党独大的可行性,也逐渐看清强势领导所可能造成的长远破坏;二来,纳吉所领导的政党已经病入膏肓,修 修补补之后固然可以继续上路,却是未来更大灾难的开始。当然,纳吉个人的信誉也早已因为军购案、蒙古女子碎尸案及在霹雳州策动的皇室政变而濒临破产。
马哈迪的“违宪论”更应打头条
所 以,纳吉,甚或其他国阵领袖谈论“善待人民”都不值得我们大书特书;相反的,他们如果能够提呈选举制度,新闻/媒体,司法,警队,行政,经济和其他领域的 改革大蓝图,才值得一份号称要“监督政府”的第一大报放上头版头条。如果政府在这方面丝毫没有意愿,也不见改革的迹象,媒体的责任就是施压、施压,再施 压。
纳 吉在太平说要“打造全民马来西亚”,同一时候,马哈迪(左图)在吉隆坡的一个公开场合炮轰巫统在霹雳州的所作所为违反宪法。两相比较,孰轻孰重?我虽厌恶 马哈迪的政治理念,却不因人废言。前首相公然否定巫统在霹雳州夺权的意义,绝对比纳吉的官腔来得有意义,不放在显著版位简直就是失职。【点击:未经议会投民联不信任票 马哈迪:霹州政府不合法】
于是,我又想到了陈裕如铿锵有力的那句话:“民主和人权是需要争取的,是一个逐步发展的进程。当你看到有阴暗的地方,就要把窗户打开让阳光照进来,这就是媒体的责任。”
所以,任何希望“让阳光照进来”的报章都不应该对权贵阿谀奉承,也不应该有不合情理的删稿甚至退稿的作法,因为一次的弯腰和退让,就是挡住了一丝民主的阳光。

一个预言

马蛤娣与墓壳里刺将如鬼魅般的缠着那吉,把那吉当成傀儡,而玩弄于股掌之中。

马蛤娣这狼子野心,将祸害那吉与他的堂弟,而且是被扯后腿而狼狈下台。

目前,那吉很可能会因为要稳住局势而讨好马蛤娣。 不过,等到墓壳里刺的势力一膨胀坐大,这预言将会实现。到时候,那吉将后悔莫及。

这预言是99%会发生的。唯一不确定的是实现的时间。

那吉是否够胆来个壮士断臂? 我觉得那吉没有这个胆量。

I've been teaching now for about fifteen years. I have two kids myself, but the best birth story I know is the one I saw in my own second grade classroom a few years back.

When I was a kid, I loved show-and-tell So I always have a few sessions with my students. It helps them get over shyness and usually, show-and-tell is pretty tame. Kids bring in pet turtles, model airplanes, pictures of fish they catch, stuff like that. And I never, ever place any boundaries or limitations on them. If they want to lug it in to school and talk about it, they're welcome.

Well, one day this little girl, Erica, a very bright, very outgoing kid, takes her turn and waddles up to the front of the class with a pillow stuffed under her sweater.

She holds up a snapshot of an infant. 'This is Luke, my baby brother, and I'm going to tell you about his birthday'

'First, Mom and Dad made him as a symbol of their love, and then Dad put a seed in my Mom's stomach, and Luke grew in there. He ate for nine months through an umbrella cord.'

She's standing there with her hands on the pillow, and I'm trying not to laugh and wishing I had my camcorder with me. The kids are watching her in amazement.

'Then, about two Saturdays ago, my Mom starts saying and going, 'Oh, Oh, Oh, Oh!' Erica puts a hand behind her back and groans. 'She walked around the house for, like an hour, 'Oh, oh, oh!' (Now this kid is doing a hysterical duck walk and groaning.)

'My Dad called the middle wife. She delivers babies, but she doesn't have a sign on the car like the Domino's man. They got my Mom to lie down in bed like this.' (Then Erica lies down with her back against the wall.)

'And then, pop!

My Mom had this bag of water she kept in there in case he got thirsty, and it just blew up and spilled all over the bed, like psshhheew!' (This kid has her legs spread with her little hands miming water flowing away. It was too much!)

'Then the middle wife starts saying 'push, push,' and 'breathe, breathe. They started counting, but never even got past ten. Then, all of a sudden, out comes my brother. He was covered in yucky stuff that they all said it was from Mom's play-center, (placenta) so there must be a lot of toys inside there.'

Then Erica stood up, took a big theatrical bow and returned to her seat. I'm sure I applauded the loudest. Ever since then, when it's show-and-tell day, I bring my camcorder, just in case another 'Middle Wife' comes along.

1948年12月10日,联合国大会通过并颁布《世界人权宣言》。这一具有历史意义的《宣言》颁布后,大会要求所有会员国广为宣传,并且“不分国家或领土的政治地位,主要在各级学校和其他教育机构加以传播、展示、阅读和阐述。”《宣言》全文如下:

    鉴于对人类家庭所有成员的固有尊严及其平等的和不移的权利的承认,乃是世界自由、正义与和平的基础,

    鉴于对人权的无视和侮蔑已发展为野蛮暴行,这些暴行玷污了人类的良心,而一个人人享有言论和信仰自由并免予恐惧和匮乏的世界的来临,已被宣布为普通人民的最高愿望,

    鉴于为使人类不致迫不得已铤而走险对暴政和压迫进行反叛,有必要使人权受法治的保护,

    ㈡ 任何人的任何行为或不行为,在其发生时依国家法或国际法均不构成刑事罪者,不得被判为犯有刑事罪。刑罚不得重于犯罪时适用的法律规定。

MARCH 1 – In extraordinary remarks today, Pas spiritual leader Datuk Nik Aziz Nik Mat said the use of the term “bumiputera” smacks of racism and deprived other races of government aid.

His comments, made in Kota Baru today, will certainly spark debate, especially since it comes from a Malay leader who is widely respected even by his foes in Barisan Nasional and Umno.

In calling the term bumiputera racist, he appears to be drawing a clear line between his Pas party and the Pakatan Rakyat (PR) from that of Umno, which has been championing the special rights of Malays.

Nik Aziz’s remarks was made in response over growing criticism from the conservative spine of Umno against comments made by DAP’s Dr Boo Cheng Hau, the opposition leader in Johor.

Dr Boo was reported to have compared “bumiputeraism” with apartheid.

Umno leaders have demanded an apology from Boo, and say his comments were a challenge to Malay rights and the constitution.

Umno’s Utusan Malaysia also described Boo’s remarks as a part of DAP’s agenda to form a republic.

But Nik Aziz was reported by Bernama as saying today that not only did the term smack of racism but deprived other races sharing similar rights and having the same identity cards of government assistance.

“In an election, other races are allowed to cast one vote, so are the bumiputera," he said.

Nik Abdul Aziz said the government should form a body to manage aid for the poor in the country and not cater only for a single group known as the bumiputera.

“I don’t like the (use of the) word bumiputera. What I like is (use of the word) poor, for all races,” he added.

He said the poor, regardless of their race, should be given assistance.

His statement appears to be also in line with Anwar Ibrahim’s concept of “Ketuanan Rakyat,” or supremacy of the people, which has been used to diffentiate PR parties from Umno’s “Ketuanan Melayu,” or Malay supremacy.

MARCH 4 - Malaysiakini reported recently that the Inspector General of Police ( IGP ) had issued a statement that all public rallies in Perak would be forbidden. This is yet another glaring example of abuse of power by one of our mercenaries of justice.

The actions by the IGP confirms what Raja Azlan Shah J ( as he then was ) had stated in one of his powerful judgments " Every legal power must have legal restrains, otherwise there will be a dictatorship. Power tends to corrupt and absolute power corrupts absolutely."

The IGP was definitely ill advised in making such a sweeping statement. Legally speaking his statement was misconceived in law and devoid of any merit.

Legally speaking, he has no right whatsoever under the law to issue a total ban on any peaceful assembly in Perak.

By making such an irresponsible statement he conveniently ignored the provision of section 27 and 27A of the Police Act 1967 respectively.

So long these two provisions remain in the statute, the people in Perak have the right to assemble in any part of Perak. The people's right to assembly is not determined by the IGP.

Talking about law on a peaceful assembly in this country, it is governed by Article 10 of the Federal Constitution.

It is a fundamental right enshrined in the highest law of the land. In theory it seems that this right is so sacred as it is protected and guaranteed by the Federal Constitution.

Unlike England where Parliament is supreme, here we have the constitution which is our supreme law. Any law which contravenes any provision of the Federal Constitution is deemed void by virtue of Article 4.

That is, however, in theory.

Sweet words are always embodied in theory. What matters is the practice. Practically speaking as far as the right to assemble peacefully in any part of this country, the assurance in the constitution is nothing.

Yes, nothing. What we have, in practical terms, is the supremacy of the police. The police supremacy reigns in the realm of public assembly in this country.

How did that happen?

Part of the blame must surely go to the framers of the constitution. Despite guaranteeing the people's right to freedom of assembly, the framers saw it fit to give the Parliament enormous power to restrict such a fundamental right.

Perhaps, the framers were too naïve. They, presumably, did not know the true colour of BN leaders who have been in command of Parliament since the first General Election.

As BN has been controlling the Parliament, it used or rather misused the proviso of Article 10 of the constitution to legislate the law on freedom of assembly.

The Police Act 1967 was thus born from this proviso.

Section 27 of the Act was inserted therein not to restrict the right to assembly but to "kill" it once and for all.

Thanks to BN supremacy in Parliament, the Malaysians' right to freedom of assembly is solely at the untrammelled discretion of the Officer in Charge of the Police District ( OCPD ).

Malaysians are at the mercy of the OCPD when they want to assemble. Yes, you can use the word OCPD and the proxy of BN interchangeably. They are different sides of the same coin.

There are two forms of assembly known under the Police Act namely, an assembly in a public place and an assembly in a private place.

The former requires a prior licence from the OCPD and is governed by section 27 of the Police Act. The latter requires no licence and is governed by section 27A of the Police Act.

In many circumstances, the police especially the OCPDs seem to form a view that this obnoxious Act gives them a carte blanche power to allow or deny the peoples' right to assemble.

To cite one example - when the organizers of BERSIH planned to organize a big gathering in the city prior to the last General Election, the OCPD made a public statement that such a gathering would not be allowed and stern action would be taken against the organizers and the attendees respectively if it was to be carried out.

Such a statement was clearly an erroneous one simply because at that time the organisers had yet to submit their application for a licence.

As the application for a licence was to be submitted to the OCPD under section 27, he , being the decision maker, should have refrained from making any statement let alone a statement prohibiting the assembly.

By making such an irresponsible statement it implied that he had already made up his mind on the application.

But the statement needed to be made because his political masters had already given a warning to the organizers.

He had to join the bandwagon of his political masters ( read political clowns ).

Now the history repeats itself.

The IGP, without any legal justification issued a total ban on public assembly in Perak. This would certainly put all the OCPD in Perak in a predicament.

The Police Act gives them discretion to process any application for a permit of any assembly in a public place. As the law confers them a power to deal with application for a permit the must, under the law, process it on case by case basis.

They may refuse a permit in Ipoh and not in Kuala Kangsar

But when the IGP has spoken as far as the OCPD in Perak are concerned they have no other choice but to say this mantra : Sorry , no permit in Perak !!!

KUALA LUMPUR: An ethnic Indian man who died in police custody in Malaysia, had been repeatedly beaten up and had multiple burn marks on his body, a second post-mortem conducted after his family's request has revealed.

The second autopsy carried out on the body of 22-year old suspected car thief A Kugan who died on January 20, contradicts the first report which said the youth had died from fluid in his lungs.

The case hit headlines in Malaysia after Kugan's family members refused to believe police reports that Kugan was not beaten up causing his death while in police custody.

The post-mortem, conducted by a pathologist from the Government run University Malaya Medical Centre (UMMC) at the request of the 22-year-old's family, also showed that he had multiple burn marks.

These V-shaped burn marks are believed to have been caused by a hot iron, Kugan's family lawyer N Surendran told reporters.

The first post-mortem only examined the body from the chest up, Surendran was quoted by local online reports as saying.

The second, which examined the entire body, found 42 other marks, burns and contusions from the sole of his feet right up to his head. The pathologist declared, based on the post-mortem, that Kugan was beaten so badly that his tissues broke down and his kidneys failed, Surendran said.

KUALA LUMPUR: Outside the skies had begun to darken as the distant rumbling thunder signaled yet another storm for Klang Valley.

Inside the press conference hall at PKR’s headquarters, the mood was equally grim and gloomy as journalists listened in horror to the lawyer appointed by A Kugan’s family.

For as he detailed each horrific mark, listed in the alleged car thief’s second autopsy report, even seasoned crime reporters were stunned. Besides the scars left on the deceased’s body, there were also signs that torture and starvation had occurred.

So distressed was everyone that when the time came for questions, none were fired at all. Although, the official reason given for Kugan’s death was “Acute kidney failure due to rapid breakdown of skeletal muscle tissue due to blunt trauma”, the details of his report revealed something more gruesome.

he report said that death was caused by the destruction of muscle which lead to the release of breakdown products of the damage cells into the bloodstream. Some of these, such as myoglobin (a protein) are harmful to the kidney and may have led to the its failure.

All in all, counsel N Surendran read out 45 counts of physical trauma on the body of the late Kugan.

“Taking away the three surgical incisions made during the first post-mortem, Dr Prashant N Samberkar said there were 42 signs of beatings on the young man’s body,” Surendran explained.

The lawyer pointed out that this was markedly different from the first autopsy conducted by Hospital Serdang.

“That report indicated that Kugan had died as a result of pulmonary edema and did not highlight any of the physical trauma suffered by Kugan.”

In the report, which was released to the family at 5.30pm on Monday, Dr Prashant noted that haemorrhage had taken place in many parts of the deceased.

“There was haemorrhage in the trakea, chest, left lung and even the heart,” said Surendran. “Other areas which showed indications of trauma included the spleen, stomach, back of the neck, spine area and soles of the feet.

“There were even burn marks on his back.”

The pathologist wrote in his report on item 39, “A 55cm x 45cm area of contusion over the entire back with multiple, repeated application of head with an instrument or object with a triangular surface, causing multiple V-shaped imprint burn wounds on the skin. These wounds are in their healing stages as is evident from the formation of black crusts and a few are infected and covered with purulent exudates”.

Surendran said that the pathologist had also discovered fatty deposits in the liver although there were no food remains in the stomach.

“Together with the physical marks on his body, we believe that he was tortured and starved for several days before his death.”

Said Teluk Intan MP M Manogaran: “What we feared all along is true and that Kugan was beaten to death in custody.

The lawyer observed that in all his years as a lawyer, he had never come across such a bad autopsy report.

“I also cannot understand why the police had to inflict such injuries to him. They should have surely known that the measures they used would have ended in death,” said Manogaran.

The DAP representative said that if the police had wanted to inflict the abuse to extract a confession, it would have been in vain.

“The courts have already established that confessions in custody are not admissible, so I don’t know why they still did it.”

Kapar’s A Manikavasagam said that from 2000-2004, 80 deaths in custody were recorded.

“We want action against all the officers, including the Selangor CPO. More than seven officers are involved in this and action must be taken in the interest of justice.”

Another prominent lawyer Gobind Singh Deo said it is time to make it mandatory for second autopsies when death occurs while the person is in police custody.

“The first one post mortem doesn’t even list down 10 percent of the injuries listed in the second one,” said Gobind.

He added that all future interrogations should be recorded on video.

Kota Raja MP Dr Siti Mariah Mahmood said she too had never seen such injuries inflicted in a person’s body before and reminded the police not to act as the executioner.

“He has not even been brought to trial and yet died in custody,” said Dr Siti. “Such brutality is unimaginable and the time for setting up of the Independent Police Complaints and Misconduct Commission.”

She also said that this was not a racial matter as the incident could have happened to anyone.

According to a representative of Kugan’s family, Ravi Roy, the report will be handed over to the Attorney General for further action today at 2.30pm.

“The family are satisfied with this report and we hope that serious action can be taken against the aggressors,” said Kugan’s uncle.

Kugan, 23, died at the Taipan police station in USJ, Subang Jaya on Jan 20, during questioning over alleged car thefts by a gang operating in the Klang Valley.

Soon after the press conference ended, heavy rain accompanied by gale-force winds descended upon Klang Valley yesterday.

KUALA LUMPUR, 28 Feb (Hrkh) - PAS khuatir tindakan yang dilakukan oleh bakal Perdana Menteri, Dato' Seri Najib Tun Razak seolah menggambarkan Umno/BN mentadbir negara dengan hasil wang judi.


Ini berikutan, tindakan Najib yang meluluskan 10 'special draw' judi sebaik sahaja menerajui Kementerian Kewangan menampakkan 'tembelang' sebenar bakal Presiden Umno itu.

Demikian kata Bendahari PAS, Dr Mohd Hatta Ramli semasa mengulas jawapan bertulis Kementerian Kewangan mengenai kelulusan 10 cabutan 'special draw' kepada Ahli Parlimen Rasah, Loke Siew Fook baru-baru ini.

"Jawapan bertulis yang diberi kepada Loke terdapat 10 kali 'special draw' (cabutan khas) yang dibuat selepas Najib menerajui Kementerian Kewangan.

"Dengan cabutan itu kerajaan mendapat hasil cukai itu sebanyak RM77,026,171.04. dan dalam jawapan kementerian itu bahawa cabutan bertujuan untuk dana pendidikan, kesihatan dan sebagainya, "dakwa Hatta.

PAS khuatir tindakan ini sekali lagi menggambarkan bahawa Umno/BN mentadbir negara dengan hasil wang judi, katanya.

Malah paling dikesali, dalam keadaan ketiadaan wang kerajaan Umno/BN begitu mudah menggunakan industri judi untuk mendapatkan sumber kewangan, ujarnya.

"Ini juga menunjukkan kerajaan sebenarnya menggalakkan orang ramai berjudi, sedangkan judi akan mengundang kepada masalah sosial dan sebagainya," kata beliau yang juga Ahli Parlimen Kuala Krai.

Paling membimbangkan, dalam keadaan ekonomi gawat, tabiat judi ini digalakkan dengan kelulusan 'special draw' akan hanya memusnahkan lagi ekonomi dan kantung rakyat, kata Hatta.

Sementara itu, Loke mendedahkan Kementerian Kewangan telah meluluskan 10 cabutan 'special draw' (cabutan khas) pada tahun 2008.

Katanya jumlah kutipan cukai yang diperolehi daripada cabutan khas tersebut adalah sebanyak RM77,026,171.04.

Kerajaan membenarkan cabutan khas diadakan berdasarkan kepada keperluan semasa yang bertujuan untuk membiayai pelbagai program dan projek pembangunan yang berbentuk sukan, kebajikan, pendidikan, kesihatan dan kemasyarakatan, dedahnya.- azm/mks. _

根据《马新社》报道,内政部长赛哈密承认,政府在早前的指示上犯下错误,导致“阿拉”字眼的使用出现混淆。

禁令生效至法庭判决为止

“目前司法审核仍在进行当中,我们就交给法庭决定。我认为在指定指示(允许使用“阿拉”字眼)时出现错误。当我们犯错时,我就必须承认,有必要详细地重新研究。”

“又出现错误......因此我们还是做出纠正。”


难道赛哈密不知道,在中东和印尼,回教徒与基督教徒都有使用“阿拉”字眼? 为何马来西亚就不能?

“柏克的思潮与我们的联系点在于,他是一名改革家,支持光辉革命(Glorious Revolution),即限制皇权的国会革命,也是一名反对滥权的国会议员。”

揭露党内投机分子勒索党职

安华也毫不掩饰地揭露党内的“枯枝”,声称党内存有“投机分子”恫言退党以向他换取党职,因此该党必须彻底清除这种现象。

他不点名指出,“一些甚至威胁我,如果没有获得任何职位就要退党,如果他们因此而要退党,就让他们走吧”。

不满警方镇压乌达雅支持者

安华也抨击警方今午镇压前往吉隆坡十五碑警局集体报案乌达雅古玛支持者,以及逮捕该党加埔国会议员马尼卡瓦沙甘(S Manikavasagam)。

“如果支持者没有阻碍交通,那么巫统在槟城的示威又如何?当时交通受到控制,根本没有人去质疑。”

此外,他非议首相阿都拉下台前的两项改革计划—反贪污委员会与司法委任委员会,都无法达致人民的要求,即一个免于巫统国阵政权宰制的独立机构。
